Terms and Conditions

Standard Supplied documents (as agreed or required);

  1. Blueprint floor plan design of the house (PDF)
  2. Recommended Piering from the house drawing (this is supplied separate to any official engineering drawings, and should not be used where engineering drawings are supplied or required) (PDF)

Items Not included in this agreement unless specified on the order sheet;

  • Crane hire
  • Redipodhouse supplied Labour and on site services beyond the delivery to site
 

General house build Items List, unless otherwise specified on the order sheet;

  • Core frame is built from 3mm Galvanized steel
  • Secondary beams and supports are 1.8mm Galvanized steel tube
  • Double glaze windows and doors all around in aluminium frames (unless ordered outside the standard spec)
    • Fly screens on all windows (if ordered)
    • Keys/Locks on all doors and windows as required
  • Fully insulated with
    • R5 rated 75mm EPS wall panels (or rock wool / glass wool fill as ordered)
    • 50mm roof EPS panels
    • 20mm composite cement floor panels
  • Wiring and electricals as per AES electrical wiring
    • Circuit breakers and Power distribution board inside the house, for isolation of power to all areas within the house
    • Caravan plug or 3 pin 32 amp plug to easily attach power to the house (if ordered)
    • LED lights and 240 dual plugs as per design throughout the house
  • 25mm water inlet pipes
  • DWV Australian PVC 100mm and 40mm Fully plumbed bathroom ready to use once attached to mains/sewerage
  • All items – sundry items required to complete assembly supplied eg
    • Bolts for external structure

    • Doors and shower screens (may require installation on arrival)
  • Bathroom items may include:
    • Tempered glass apartment shower room
    • Washstand
    • ceramic toilet
    • stainless steel floor drain

Liability;

  • For the supply of new houses, Redipodhouse provides a warranty against defective Materials and Workmanship, for a period of twelve (12) months from the date of delivery, and a warranty on the structure, for a period of twelve (12) months from the date of delivery.
  • If you have undertaken any modifications, additions or alterations to the house in any way other that what is within the agreed contract and instructions, you will not be eligible for either warranty period offered by Redipodhouse.
  • For the supply of refurbished or second hand buildings, they are sold on an as is where is basis, with all faults and defects, whether apparent or not and no warranties whatsoever (express or implied) shall be provided.
  • Appliances, equipment and accessories supplied and/or installed that are incorporated into the Building, or any equipment supplied in connection with the Building or this Contract or that are delivered separately will only be subject to any warranty (or balance thereof) provided by the original manufacturer. Redipodhouse does not offer any extension on the manufacturer’s warranty whatsoever for Accessories.
  • Any repairs, modifications, movement, relocation, positional change from it’s original planned position, improvements or additional works outside of supplied foundation drawings of any nature that are carried out by You or any other person without written consent of Redipodhouse will void any warranties provided under this Contract and will otherwise be at your sole risk and expense. Redipodhouse will not accept any responsibility for any unauthorised works, including any actions, Claims and Liabilities in respect of death, damage or injury to any person or property resulting directly or indirectly therefrom.
 

Warranty Exclusions;

  • You have acknowledged and understood and accept that the building has travelled by road and water to be delivered to your site, it might be subject to wear and tear of a reasonable nature during its travels and is not covered under a defective workmanship claim or warranty repair, unless approved by Redipodhouse in writing.
  • This exclusion does not affect conditions or warranties that cannot be excluded under law, including under the Australian Consumer Law and only where any such conditions or warranties cannot be excluded:
    • You are entitled to a replacement or a refund for a major failure and to compensation for any other reasonably foreseeable loss or damage.
    • Any Building presented for major failure repair may be replaced by refurbished buildings, structures, goods or accessories of the same type, rather than being repaired and refurbished parts may also be used to repair the Building.
    • In the event that an insurance claim results in the insurer paying a sum of money, You will only require Redipodhouse to make good loss or damage up to a maximum amount obtained from the insurer and Redipodhouse shall not be liable to You whatsoever for any other Liabilities or Consequential Loss.
    • In the event that a claim for a warranty repair, replacement or refund is made by you to Redipodhouse, Redipodhouse are entitled to photos, videos or reports as to the issue complained of, to supplement the claim. It is wholly at the discretion of Redipodhouse to troubleshoot the claim and if necessary your responsibility to carry out the troubleshooting and identify the issue if at all possible. If the issue complained about is caused as a result of the lack of care, maintenance or act by You, You will be responsible for any and all costs incurred and the repair of it.
  • Redipodhouse will not be liable for any damage nor any warranty claims sustained to the house from abnormal conditions, flooding, fire, hail, tornado, cyclone, misuse, damage from vehicle accidents or other weather events once the house has been delivered to site which causes damage to the structure, or ripping, damage or discolouring/fading in any way.
  • Redipodhouse will not be liable for any small dents, scratches, colour variations, damage during installation or fading over time.
  • You accept that the house might have a minor aesthetic imperfections which does not change the overall longevity, use or viability of the product and does not amount to a major failure or defect.
  • We offer a Product that is manufactured in our factory in China. Due to the price point and nature of our business, our Products may have imperfections and there could be damage in spots that cannot be inspected prior to delivery. Minor defects are deemed satisfactory by You and Us.
  • Where items may not operate as expected, but are deemed to be ‘operating as designed’ or built by the manufacturer to their specification;
    • Redipodhouse will conduct checks, within reason, to ensure the manufacturers specifications have been achieved, and while we will support wherever possible to make sure the operation of all house features is to customer expectation, unfortunately there are times where manufacturers operation and customer expectation are not aligned.
 

Delivery Times;

  • Estimated build and shipping times
    • These are provided at the point of ordering, and are an estimate only from our current build and shipping time experience, please be aware that both can be impacted due various factors, and we will do our best to deliver to these advised times.
    • We will keep you advised of any significant changes, and provide updates regularly throughout build and shipping.
  • local delivery times
    • We will advise a landing time for the vessel roughly 1 week out, from this we can approximate a 3-4 day delivery window, we will work with you to determine the best delivery date at this time.
    • If for any reason on the day the container or delivery site may be inaccessible due to weather, we will contact you and coordinate an attempt delivery at the first available or suitable time, as determined by the truck driver.
    • If you need to change the delivery date and time for any other reason, storage and additional transport costs may be incurred, we will discuss these options with you at the time.
    • If you are organising pickup and delivery to site, it must be within the 3 day window provided by the container depot, container holding fees may apply beyond this time.
    • If you do not have machinery at the delivery location and are unable to unload the house, you must prearrange with Redipodhouse prior to dispatch, for either a delivery vehicle capable of unloading the house at a safe and suitable location at the delivery site, or for an appropriate machine to meet a delivery vehicle onsite to unload the delivery vehicle. You accept that the addition of a vehicle capable of self unloading, or an additional machinery (such as forklift or crane) might incur additional fees which you are responsible for.
    • If a delivery vehicle or machine organised by Redipodhouse is at your site for a period longer than 60 minutes, you might be responsible for additional charges.
    • You accept that our delivery operators will only deliver to a feasible and safe location at your delivery site. Our delivery operators will exercise their own discretion with each delivery and neither they, nor Redipodhouse will be responsible for any relocation charges you might incur in picking up and replacing your house at an alternate location.
    • You must inform Redipodhouse in writing within 24 hours of receipt of the house of any damage incurred during transit otherwise it is deemed delivered onsite undamaged.
     

Payment Terms, refunds and cancellations:

  • Redipodhouse does not offer cancellations or refunds for deposits on any customised orders unless otherwise advised in writing to you after review.
  • Redipodhouse does not offer cancellations or refunds for change of mind or delays associated with delivery or manufacturing unless otherwise agreed in writing.
  • Full and final payment is to be completed on delivery, unless other payment terms have been agreed before deposit and noted on the build and term sheet,
    • By agreement prior to deposit following options are available;
      • a %10 final payment can be held for the house after delivery date, but this %10 final payment must be completed within 7 days of the house being delivered to site.
      • No Deposit, with full and final payment made on delivery, this option will incur additional costs to be determined based on the full cost of the build, and noted on the build sheet prior to starting build.
    • Ensure you have the ability to complete all payments as required on time to avoid incurring additional fees and charges.
    • Any payments not made on time as agreed in the above terms will incur
      • a late payment fee of $250, and after the first day;
      • an interest at the rate of 14% per annum on all overdue amounts owed by you to us. Such interest will be calculated daily until full and final payments are received
    • If you fail or refuse to pay the balance deposit or any monies due under any invoice sent to you by Redipodhouse in accordance with the payment terms of the invoice, Redipodhouse can deem the Contract at an end and terminate the Contract with you in writing. Such termination can result in the forfeiture of any monies paid by you and no claim as to any title to the building, the subject of the Contract.
    • Upon the occurrence of an Event of Default and without limiting any other rights at law, in equity or elsewhere, Redipodhouse may (but are not obliged to):
      • Suspend performance of or terminate this Contract, by notice in writing to You;
      • Declare the balance of the Price immediately due and payable by You;
      • Retake possession of the Building and remove same from the Site, at Your expense; or
      • Remedy any default committed by You under this Contract, at Your expense.
    • In the event that Redipodhouse terminates this Contract due to breach, You will be no longer entitled to possession of the Building and You:-
      • Irrevocably grant to Redipodhouse the licence and authority to enter upon the Site where the Building is located and use such reasonable force as may be necessary for the purpose of removal of any Building sold to You, together with any property in, on or attached to the Building (regardless of whom such property may belong to) at Your sole cost and expense; and
      • Must immediately return the Building to Redipodhouse (at Your cost and expense) and nothing in this Contract gives You any express or implied right or entitlement to sell, hire, lease, encumber, or grant any right or interest whatsoever in the Building, nor any right to set off, deduct, withhold or counterclaim against any amounts that may be due and owing to Redipodhouse.
    • If Redipodhouse repossesses the Goods from any Site and retains, sells or otherwise disposes of the Building or any items within the Building, then You hereby release and indemnify Redipodhouse for all claims, costs, Liabilities, Consequential Loss and any other matters arising there from, including in respect of any legal costs, on a full indemnity and solicitor client basis.
    • Redipodhouse will have all rights and remedies set out in this Contract in addition to those otherwise available at law. All such rights and remedies are cumulative. You must pay all costs and expenses paid or incurred by Redipodhouse in enforcing its rights under or in connection with this Contract, the supply and installation (if applicable) of the Building including, without limitation, legal fees and court costs on a full indemnity and solicitor client basis.

Confidential Information, Specifications and Drawings

  • This Contract and all negotiations leading to its execution, together with all documents whatsoever disclosed by Redipodhouse to you are to be treated by both parties as confidential (“Confidential Information”) and will not be disclosed to any third party without either parties written consent, unless same is already in the public domain.
  • You understand that no representations have been made about the fitness of the Building, or whether it would be permitted to be installed at your site.
  • Redipodhouse does not warrant any compliance with any local laws or legislation. It is a matter for You to undertake your own research and understanding of any local or Government law or legislation affecting the liveability, suitability or acceptability of installing and/or use of any Building offered for sale by Redipodhouse.
  • You agree that all specifications for your order of the Products will be included in the quote provided by us and you agree that the information provided in the quote is accurate.
  • You agree and acknowledge that we will rely on information provided by you in relation to your order for Products and any costs incurred by us in reliance on incorrect or inadequate information that may result in additional costs charged to you, which you will be liable for.
  • We are not legally responsible for any loss or damage you might suffer in relation to purchasing one of our Products, whether from errors or from omissions in our documents or information.
  • We take no responsibly for any penalties incurred against you from council or any government bodies for the use of the Product.

Practical completion and insurance;

  • Redipodhouse will review and replace any incorrectly supplied items
  • Redipodhouse will review and repair any items broken or deemed damaged at the point of opening and inspecting the house (the house should be opened and checked within 7 days)
  • Supply of any items ordered (found missing) and not supplied at the point of opening and completion of installation (installation should occur within 7 days)
  • Items broken on arrival or missing must be reported to Redipodhouse within 7 days of the house arriving on site, this allows us to complete the insurance claim within their required time frame, we will discuss options that are available to us to resolve the issues.
  • Items deemed as requiring repair or replacement, are done so outside of the final payment on delivery requirement,
    • For all items that need to be addressed,
      • ensure photo’s are taken of each item
      • document in detail the item
      • and request quotation for repairs where possible
    • This will expedite the insurance and repairs.

Replacements & Repairs

  • In the event a replacement part/material is sent to the customer, these parts are to be fitted at the customers own expense.
  • Any repairs or replacements on buildings completed by the customer or tradesperson are at the customers own expense unless agreed by Redipodhouse in writing.
  • Redipodhouse will not be liable for any damage nor any warranty claims sustained after Practical Completion.
    • Redipodhouse will only warranty damage to the Building up to Practical Completion only.
    • You are deemed to have accepted Practical Completion immediately upon the delivery of the building to site.
  • Redipodhouse does not offer Home Warranty Insurance as the Building is not sold subject to a Building Contract, but sold as a product.
  • Redipodhouse recommends that all Buildings be secured to the ground on the Site with footings, tie downs or cross bracings. The Price does not include the cost of tie downs unless specifically provided for in the build/term sheet.
  • You shall bear the cost of all council required tests and inspections whatsoever and wherever such testing or inspections take place.
  • Redipodhouse does not warrant any compliance with any Electrical, Building Code or Plumbing codes that are specific to local or Government legislation but will maintain its compliance with national building codes and bodies where possible or attempt to comply and/or conform with relevant industry standards. It is always a matter for You to ensure that any Building purchased and installed and connected to existing services at your site, is done so in compliance with any local laws or Government legislation specific to You.

Disputes;

  • If any dispute is not resolved by negotiation within 28 days of receipt of an invitation to negotiate, the parties will attempt to resolve in good faith through an Alternative Disputes Resolution procedure (ADR). If this is unsuccessful then either party can refer the matter to arbitration.

GST;

  • Unless otherwise stated, all prices or amounts set out in the Purchase Transaction, build/term sheet, quotation, invoice or elsewhere in this Contract are inclusive of GST

Contract General;

  • You have satisfied yourself that Our Product is suitable for your intended purpose and location.
  • You acknowledge that You have had sufficient time and opportunity to consider the Contract and, obtain legal, financial and other professional advice in relation to same and otherwise satisfy itself as to the suitability of this arrangement for itself.
  • If You instruct Redipodhouse in writing or Redipodhouse considers any instruction from You, whether verbal or written to be an instruction to perform a variation after construction begins, then Redipodhouse will attempt to perform the variation but only after You have agreed to the price or cost of such variation, in writing. The agreed price of the variation will be added to or deducted from the price and any extension estimates to any timeframes shall be given accordingly.

Force Majeure

  • Should circumstances beyond our control hinder or prevent our provision of the Products to you, we will be free from any obligation to provide the Products to you whilst such circumstances continue.
  • For as long as the circumstances beyond our control continue, we will attempt negotiation with you on the cancellation of the contract and agreement to acceptable terms, or keep your order with us on until such circumstances have ceased.
  • Circumstances beyond our control, or Force Majeure events, include but are not limited to:
    1. illness or injury to us;
    2. health pandemic/crisis/virus
    3. strikes;
    4. lockouts;
    5. riots;
    6. natural disasters;
    7. fire;
    8. war;
    9. acts of God;
    10. Government decrees, proclamations or orders;
    11. transport difficulties; and
    12. failures or malfunctions of computers or other information technology systems.
 

Storage Fees;

  • If the customer is advised by Redipodhouse that their building is ready for delivery, but the customer indicates to Redipodhouse that they are unable or unwilling to accept delivery of the building at the time or dates provided, the building is either:-
    • Returned to Redipodhouse holding facilities incurring storage fees as tabled herein
    • Held for a period time longer than a 60 minutes on a transport vehicle facilitated by Redipodhouse incurring additional fees from the deliverer, which shall be passed on to the customer once invoices are received.
  • When the delivery date is delayed for more than 3 days,
    • the house will be considered as having achieved Practical completion, and due payment in full.
    • The house however will be considered undelivered or in transit for the purpose of Insurances which will still be covered until delivery to customer site.
Then the customer will be charged the following rates at the discretion of Redipodhouse, such rates to be paid in full prior to delivery/redelivery:
  • For 20ft units, a storage fee of $115.00 per product per day will apply until delivery or pickup is completed.
  • For 30ft units, a storage fee of $155.00 per product per day will apply until delivery or pickup is completed.
  • For 40ft units, a storage fee of $175.00 per product per day will apply until delivery or pickup is completed.
  • All other products and trailers will incur a storage fee of $115.00 per product per day until delivery or pickup is completed.

Installation:

  • Each house being custom built will have both a generic build guides and customised fitting and fixtures guides available, Redipodhouse will make every attempt to have these guides available prior to delivery and/or on request.
  • If you are unable to install the house yourself, we recommend you engage a licensed tradesperson to install. Any costs associated with this installation will be your responsibility.
  • You are responsible for ensuring your own safety and that of any persons installing the house. Redipodhouse will not be liable for any loss, damage, injury or death associated with any installation or use of the house.
 
  • Please complete the following information and return when you have read and understood all terms and conditions, Redipodhouse receipt of this signed agreement will be considered a binding contract
  • Building will begin once the agreed terms and conditions have been completed and returned, and deposit received.
  • We will advise immediately where possible:
    • when deposit or other payments received and provide receipts
    • building is scheduled to begin build,
    • House is ready for visual inspection prior to loading,
    • Loading on board, and updates throughout shipping stages.
    • Container released and ready for collection
    • Scheduled Day of delivery
  • Redipodhouse will provide photo’s and videos where available of the house during the build and once build is complete for you to confirm the build is being done to standards and as agreed, and finally Rediposhouse will request your review and written approval of the build as evidenced before packing and shipping.
